On Feb. 28, the California Court of Appeals ruled against homeschooling by parents who are not certified as teachers. This puts more than 150,000 children at risk as possible truants and their parents at risk of prosecution.”
Justice H. Walter Croskey representing the court in a 3-0 ruling stated that “parents do not have a constitutional right to homeschool their children,” and that “parents have a legal duty to see to their children’s schooling under the provisions of these laws.”
Lloyd Porter, a member of the California Teachers Association board of directors was happy about the decision; “We always think students should be taught by credentialed teachers, no matter what the setting.”
California Govenor Schwartzenager has come out against this Appeals Court ruling ruling on homeschooling and promised to change the law if necessary to guarantee parents the right to educate their children at home.
The California Courts typify big government and the “nanny state”. The fact that you don’t think your children should be taught the secular version of evolution or the normality of homosexuality and transsexuality in a public school setting means nothing to them. They Court (three men) takes the position that only they know best what is good for your child and they will decide what is an appropriate education, not you.
Schwartzenager felt differently: “Every California child deserves a quality education, and parents should have the right to decide what’s best for their children,” Schwarzenegger said in response to the ruling, which said children educated at home must be taught by a credentialed teacher.
“Parents should not be penalized for acting in the best interests of their children’s education,” Schwarzenegger said. “This outrageous ruling must be overturned by the courts, and if the courts don’t protect parents’ rights then, as elected officials, we will.”

AMMENDEMENT IX
The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people.
While there may not be anything specific referring to anyone’s right to homeschool their own child (or anyone else’s), the Ninth Amendment should cover it. At the time The Constitution was signed, there were not too many state sponsored schools and certified teachers, if any, were few and far between.
